Even when a driver can legally do so, passing on a two-lane road can be dangerous. Virtually every South Carolina driver knows that plenty of room is required to complete a pass safely. When a driver fails to take into consideration how much room is needed, a car accident can occur that can injure or kill the people involved.
The South Carolina Highway Patrol says that the driver of a Jeep attempted to pass another vehicle but did not take the time to make sure he had enough room to complete the maneuver. The driver and his four passengers were heading westbound on Highway 278 when the maneuver was attempted. The driver and sole occupant of an eastbound vehicle had the misfortune of being in the path of the Jeep. The two vehicles collided.
The driver of the oncoming vehicle suffered fatal injuries in the crash and died at the scene. The driver of the Jeep and his four passengers all suffered unidentified injuries and were transported to a hospital in the area. The extent of their injuries and current conditions was not available. The accident is still under investigation, and it is not yet known whether any charges will be filed in connection with the tragedy.
Even if there are no criminal charges filed, the family of the victim may file a wrongful death claim in civil court. Proving negligence on the part of the driver deemed responsible for this deadly car accident could lead to an award of damages for the deceased victim’s survivors. Moreover, the injured passengers have a similar right to pursue personal injury claims for damages. Any monetary restitution awarded could help the accident victims, including the family of the deceased driver, deal with the expenses incurred as a result of the car accident.
