Law enforcement agencies and advocacy groups throughout South Carolina do what they can to educate the public regarding the dangers of drinking and driving. Unfortunately, that does not stop some drivers from getting behind the wheel after consuming enough alcohol to be considered intoxicated under state law. As a result, suspected drunk drivers continue to cause car accident deaths.
The South Carolina Highway Patrol believes alcohol was a factor in a recent crash that took the life of a 58-year-old woman. According to preliminary reports, a 45-year-old woman was headed westbound on S-377 when her vehicle crossed into the oncoming lane of traffic. Her vehicle slammed into the victim’s car, which was traveling in the eastbound lane.
The eastbound driver suffered severe injuries, and emergency responders rushed her to a hospital in the area. Unfortunately, the woman succumbed to her injuries. In the meantime, troopers suspected the westbound woman of driving under the influence, and she faces charges of felony DUI. In light of the victim’s death, additional charges could be filed when the investigation into the incident is concluded.
In the meantime, the family of the victim may file a wrongful death claim against the presumably impaired driver. Even if prosecutors are unable to obtain a criminal conviction against the woman in connection with this fatal car accident, a civil court may still award a judgment for monetary damages to the family incurred as a result of the death of their loved one. Any monetary judgment awarded, which must be based upon proof of driver negligence, could assist the family with the expenses and other damages sustained due to the victim’s death.
