The South Carolina town of Pamplico may have been shocked to hear about the death of a 75-year-old man recently. He was killed in a pedestrian vs. car accident outside of his home. The driver of the car that hit the elderly man was only 17 years old.
Preliminary reports from the South Carolina Highway Patrol indicate that the elderly man was attempting to cross the street outside of his home when the young driver hit him. The victim was taken to an area hospital. Emergency medical personnel were unable to save the man’s life and he was pronounced dead at the hospital.
No one in the car was injured. There has been no indication yet as to whether charges will be filed against the teenage driver. No discussion of factors such as speed, impairment or inattention on the part of the driver or the pedestrian has been released. It is not known if the driver had enough time to stop had there not been other contributing factors or if the pedestrian stepped out in front of the car without there being enough time for the driver to stop. It may be some time before the details of the crash come to light.
The family of the victim has the right to file a wrongful death claim against the driver even if no criminal charges are filed in connection with the car accident. If the driver’s actions contributed to the death of the pedestrian, the court may award the family monetary compensation. This can occur even if the driver’s actions do not reach the level of having been criminal.
