From time to time, the South Carolina Highway Patrol sets up checkpoints for a variety of reasons, such as to locate drunk drivers or make sure drivers have valid licenses. The checkpoints can be anywhere in the state in an effort to reduce car accident injuries and deaths. On March 10, troopers set up a driver’s license checkpoint off Interstate 26 in Charleston County.

At approximately 11:30 p.m. that night, a vehicle occupied by two 19-year-old men approached the checkpoint. At first, they stopped, but when the driver was asked for his license, he sped away from the checkpoint. One of the South Carolina Highway Patrol troopers at the scene turned on his lights and sirens hoping to stop the vehicle.

Unfortunately, the vehicle eluded the trooper, but sheriff’s deputies saw the vehicle go speeding by shortly before it slammed into a fence. The vehicle then caught on fire. The driver survived the accident but succumbed to his injuries later at the hospital, and the passenger died at the scene of the accident. The scene was closed for several hours while the onsite investigation was conducted. According to the county coroner, the vehicle fire was not the cause of death for either man.

This may provide some consolation for the family of the deceased passenger. Even as they mourn the death of their loved one in this fiery car accident, they may incur expenses that are difficult to afford. Filing a wrongful death claim could help the family try to recover those costs. In order to achieve a judgment for monetary damages, the family must first prove negligence on the part of the driver.
