On a recent Monday at around 11 p.m., the South Carolina Highway Patrol responded to the scene of a single vehicle crash. By the time troopers arrived at the scene, it appeared that both the driver and passenger in the vehicle had lost their lives. The county coroner confirmed that the two had died as a result of injuries received in the car accident.

So far, the only details of the crash reported by the South Carolina Highway Patrol indicate that the vehicle the two were in had run off the road. When it did, it flipped over and came to rest in a pond near the roadway. In this case, the fact that the 21-year-old and 19-year-old were properly restrained did not help them survive.

Since there are no survivors to interview regarding what caused the driver to lose control of the vehicle, it could take some time to determine exactly what led to the crash. The coroner ordered autopsies to determine the exact cause of death. Even though no charges will be filed against the driver since he is deceased, determining the cause of the accident could help the families as they struggle to deal with the loss of their loved ones.

The family of the passenger may exercise its right to file a wrongful death claim against the estate of the driver. Presenting evidence to establish negligence on the driver’s part could lead to an award of damages that judges often make in car accident cases. Monetary damages could alleviate the burden of the unexpected expenses that come with the premature loss of a family member.
