The term “whiplash” may be used to describe a soft tissue neck injury following a traffic accident or car crash. The injury is common, often diagnosed by ER doctors or chiropractors when they see someone who was in a car that was rear-ended. The force of a rear-end accident may cause the driver or a passenger’s head to be forcefully thrown forward and then back, being extended beyond normal movement.
The main symptoms of whiplash are neck pain and stiffness. Pain may worsen with neck movement and looking from side to side. People may also experience headaches, fatigue, dizziness. The actual injury may involve tendons, ligaments, or muscles.
Whiplash injuries can occur at speeds of as low as ten mph. The speed of the vehicle does not determine how severe an injury is. While you cannot avoid all accidents, you can protect yourself by sitting safely in your seat and not stick your feet on the dashboard or out the window. Adjust and position your headrest to support your head and wear a seatbelt.
Insurance claims adjusters may downplay whiplash injuries and get you to agree in a recorded statement that your pain isn’t that bad, because it is merely a soft-tissue injury. No matter how minor your injuries may seem, as a general rule, you should not provide a recorded statement, and you should not accept any compensation offer without first speaking with a lawyer. You may be entitled to far more compensation than is initially offered.
Damages available in a personal injury claim may include medical care and treatment expenses, lost earnings, and pain and suffering.
