A South Carolina Highway Patrol trooper was just initiating a traffic stop when the car he was trying to pull over fled at a high rate of speed. The vehicle ultimately crashed. Two people were killed and one other person was injured in the auto accident.
The accident is still under investigation. One of the first things that investigators are attempting to determine is whether the South Carolina Highway Patrol officer pursued the vehicle when it failed to stop. It is also not yet known why the vehicle was being pulled over in the first place.
As of this writing, the third occupant of the vehicle is still recovering in the hospital from the injuries sustained in the wreck. The driver of the vehicle died in the accident along with another passenger. Investigators will most likely interview the surviving passenger in order to determine what went on inside the vehicle and why the driver failed to obey the officer’s attempt to pull over the car. Of course, depending on the injuries sustained by that passenger, it may not be possible.
If the officer did pursue the vehicle, it will have to be determined whether the pursuit was authorized or worth the risk. The family of the deceased passenger, who was only 20 years old, may be able to file a wrongful death claim not only against the estate of the driver, but against the trooper and the state as well depending on the outcome of the investigation. The same possibility exists if the surviving passenger decides to file a personal injury claim in connection with this auto accident.
