Since the beginning of the year, dangerous winter weather has descended on many states, including South Carolina. Reports of numerous accidents across the affected areas have become commonplace. Tragically, many have resulted in serious injuries and/or deaths. One serious car accident occurred recently that took the life of one passenger and sent the driver and another passenger to the hospital.
Three people occupied the only vehicle involved in the crash. The South Carolina Highway Patrol reports that the trio was traveling through Hampton County at approximately 2 a.m. on icy roads. The vehicle slammed into a tree that was down.
The 24-year-old woman who died was in the front passenger seat when the crash occurred. The driver, age 23, suffered serious injuries. The other passenger suffered injuries that were not life-threatening. Both were taken to the hospital, and their current conditions were not reported.
Understandably, the possibility of having an accident increases when roads are icy. Even when drivers are cautious and slow down, it does not take much for a driver to lose control of his or her vehicle. The fortunate ones suffer no injuries, but the odds are that a portion of the accidents will result in serious injury or death.
Despite the fact that a driver may not face criminal charges in a car accident where weather was a principal factor, the driver could still face claims for civil liability. In this case, the family of the deceased woman may file a wrongful death claim while the other passenger may file a personal injury claim against the driver. Successfully litigated claims could yield an award of damages to cover the cost of monetary damages accrued because of the crash.
