A passing motorist found a South Carolina man lying on the side of the road around 3 a.m. on Dec. 8. He was hardly breathing and not moving . Despite the efforts of both emergency personnel and medical personnel at MUSC, the hit-and-run car accident victim died later that same day. Authorities in Charleston County asked that anyone with information regarding the incident to contact them.

Police located the vehicle believed to be the one that struck the man. A black Dodge Charger, it was found at an apartment complex near where the man was discovered. A car cover initially concealed the car. The person driving the vehicle that morning has yet to be located.

The driver left the scene without trying to help the victim. As it turns out, the 22-year-old victim was in the care of South Carolina Mentor, a facility charged with the care of special needs and/or disabled children and adults. A statement issued by the facility indicates that it will cooperate fully with law enforcement in the investigation. One question officials and the victim’s family may have is why the man was walking the streets at 3 a.m.

Between questions directed at the facility and locating the driver of the vehicle involved in the crash, the investigation could take some time to complete. While they are waiting, the surviving family members surely grieve for their lost loved one. In addition to the emotional ramifications of his death, the financial burdens that accompany such tragedies need to be dealt with as well. A review of all of the circumstances surrounding this car accident may help the family assess the viability of a wrongful death lawsuit. Should they decide to move forward with such a claim, a decision must necessarily be made to determine which parties to include as defendants.
